By proceeding to use our services you agree that we may process your personal data (including sensitive personal data) that we collect from you in accordance with the Data Protection Act 1998 and any other data protection laws that apply. For the purposes of data protection laws we (Spark Energy) will act as ‘Data Controller’ in this scenario.
By registering to use this service you agree to us retaining your banking details. This information is held securely, and is used solely in accordance to allow use of this service.
By registering to use this service you agree that we are able to use all contact information provided in order to update your customer records, should we ever need to contact you in the future regarding your energy supply with us. This includes:
- Telephone number(s)
- Email Address
By accepting these terms you agree to your contact information being used for any marketing communication. Any marketing communication sent to you will have the option for you to ‘Opt Out’.
We maintain security procedures and safeguards in connection with the collection, retention and destruction of customer information.
Our Online payment facility is hosted externally by our partner, PayPoint Ltd. PayPoint is compliant with the Payment Card Industry (PCI) data security standard and will handle your payment in accordance with our instructions, and their terms and conditions which you agree to when payment is made in this manner. The payment website secures your personal information using Comodo SSL certification which encrypts all information including credit and debit card details.
1.1 ‘You’ or ‘Your’ means, You as the individual, sole trader, partnership or limited liability company named on the online registration form for the service of use.
1.2 ‘Us’, ‘Our’ or ‘We’ means Spark Energy Ltd (“Spark Energy”)
1.3 ‘Security Information’ means
1.3.1 The User ID, and
1.3.2 The Password which You will Choose to register Your account
1.3.3 Any other security processes to which We notify to You
2. Security Information
It is Your responsibility to ensure Your security information remains secret. You must take all reasonable precautions to prevent unauthorised or fraudulent use. This includes, but is not limited to:
2.1 Choosing a password when first registering for the service
2.2 Never telling anyone else Your security information, including Spark Energy Staff
2.3 Never recording Your security information down on any documents
2.4 Changing passwords if You know or suspect that someone else knows your security information
2.5 You must notify us immediately should You become aware of any error or suspected error in the service or in any transaction resulting from using this.
3. Provisions of this Service
3.1 You are responsible for obtaining and maintaining your own compatible computer systems or mobile devices, including all equipment, software and communication lines required by You to properly access the service. Spark Energy holds no responsibility or liability with respect to Your equipment.
3.2 You are responsible for all telecommunications and similar charges incurred by you in gaining access to and using the service
3.3 We will not be held liable to You if changes in this service affect:-
3.3.1 Your Equipment
3.3.2 Require modification or alteration to your equipment; or
3.3.3 Otherwise affect the performance of your equipment
3.4 The service may be altered from time to time. We will notify You of significant changes to the service.
3.5 You are solely responsible for ‘virus checking’ all information sent to You by Us. We shall not be liable for any corrupted information sent to You, by Us.
3.6 The Service is provided subject to the condition that no abuse or fraudulent use of this service, this includes but is not limited to:
3.6.1 Attempting to, or actually obtaining, accessing, altering, de-compiling, reverse engineering or destroying the data files, programs, procedures and/ or information of Spark Energy or another customer of Spark Energy.
3.6.2 Assisting another to perform the acts as specified in clause 3.6.1
3.6.3 Using the service in a manner as to interfere unreasonably with the use of the service by another other customer of Spark Energy.
By accepting these terms of agreement, you are agreeing to abide by the above clauses, should any of these be knowingly breached, Your registration for using this service will be discontinued immediately.
